Update - Fourth Deed of Variation endorsed by Council
The proposed Fourth Deed of Variation to the Rhodes West Station Precinct was placed on public exhibition from 5 November - 3 December 2024. Following the public exhibition period, a report was taken to Council on 3 December 2024 where the Fourth Deed of Variation was endorsed.

Background
In 2014 the City of Canada Bay Council entered into a Voluntary Planning Agreement (VPA) with Walker Street Development Pty Ltd and Billbergia Pty Ltd (Developer) for the Rhodes West Station Precinct. A VPA is an agreement Council can enter into with a developer. Under these agreements, a developer agrees to provide or fund public amenities, public services, affordable housing or other infrastructure as a condition of building their development.
The development site is bound by Gauthorpe Street to the north, Walker Street to the east, Mary Street to the south and Marquet Street to the west. The Rhodes West Station precinct development is being undertaken by Billbergia in three stages.
Draft Fourth Deed of Variation to the VPA
The proposed Fourth Deed of Variation to the Rhodes West Station Precinct – Marquet and Walker Street Planning Agreement between the City of Canada Bay (Council) and the Developer – has resulted from the opportunity to use surplus levies from development to undertake further road and footpath works within the Station Precinct.
Whilst the existing Planning Agreement requires the Developer to undertake certain roadworks, Council has identified further works to be completed and is seeking to have all roadworks be completed at the same time. This would minimise disruption and as such, the additional works need to be incorporated into a variation to the existing Planning Agreement. The proposed variation does not include any changes to the existing development approval or development controls for this site.
In addition, further infrastructure works are proposed which include extending the area of road and pavement reconstruction, new pedestrian crossings, and the provision of landscaping and street furniture.
Under existing arrangements, the identified infrastructure would be developed over several stages as development proceeds within the Walker Street Rhodes Precinct. Having these works completed at the same time will minimise the period of disruption, deliver more consistent outcomes, and result in cost savings.
