Background
The City of Canada Bay Council entered into a Voluntary Planning Agreement (VPA) with Walker Street Development Pty Ltd and Billbergia Pty Ltd in December 2014 (Developer) for the Rhodes West Station Precinct.
The development site is bound by Gauthorpe Street to the north, Walker Street to the east, Mary Street to the south and Marquet Street to the west. The Rhodes West Station precinct development is being undertaken by Billbergia in three stages.
Third Deed of Variation to the VPA
A Deed of Variation was required to be entered into between the Developer and Council, to amend the VPA, so that it deals with the application of the VPA to floor space approved as a consequence of amendments to Council’s local environmental plan made by State Environmental Planning Policy Amendment (Rhodes Precinct) 2021 and State Environmental Planning Policy Amendment (Rhodes Precinct) 2022.
Arising from the above, the wording of the VPA is proposed to be amended by the third Deed of Variation to require the payment of monetary contributions to Council for additional residential Gross Floor Area (GFA) which is in excess of that which was permitted on the land prior to the finalisation of the above 2 State Environmental Planning Policies.
The Deed of Variation to the VPA confirms that a contribution is required towards the Rhodes Recreation Centre and other public benefits for additional GFA provided on the land.
